These Terms of Service (“Terms”) govern your access to and use of the KlickGen website and application at klickgenai.com (the “Service”). By using the Service, you agree to these Terms.

2. Eligibility and accounts

• You must be able to form a legally binding contract.
• You are responsible for activity under your account and for keeping your login credentials secure.

3. YouTube connection (Google OAuth)

The Service may allow you to connect your YouTube account via Google OAuth to access channel data and analytics for insights and recommendations.

Scope disclosure (Option B): Our current OAuth setup may request permissions that are broader than strictly read-only access. Even if you use only analytics/insight features, you may see scopes such as youtube, youtube.readonly, yt-analytics.readonly, youtube.force-ssl, youtube.upload, and partner-related scopes during authorization. We do not upload videos or modify your channel unless we explicitly offer such a feature and you choose to use it.

You can disconnect YouTube from your profile in KlickGen, or revoke access directly in your Google account settings.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes.
• Attempt to bypass security measures or access non-public areas of the Service.
• Interfere with or disrupt the Service (including rate-limiting or excessive automated requests).
• Reverse engineer or attempt to extract source code or trade secrets except to the extent allowed by law.

5. Subscriptions, billing, and refunds

Some features require a paid subscription. Payments are processed by Stripe.

• Billing: by subscribing, you authorize us (through Stripe) to charge your selected payment method according to your plan.
• Cancellation: you can cancel your subscription to stop future renewals (access may continue until the end of the current billing period).
• Refunds: refund handling is managed through Stripe. If you believe you are entitled to a refund, contact info@klickgenai.com. Refunds may be provided at our discretion unless required by applicable law.

6. Intellectual property

• The Service (including software, design, and branding) is owned by KlickGen AI and its licensors and is protected by intellectual property laws.
• You retain rights to content you submit to the Service (such as your prompts, saved ideas, and messages), subject to the license below.

License to operate the Service: you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely to provide and improve the Service.

7. Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not guarantee that recommendations, insights, or analytics will produce specific results. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, KlickGen AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service, users, or third parties.

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
